The European Commission has requested that Belgium end alleged discriminatory laws on personal tax deductions for residents with foreign source income, the taxation of dividends paid by foreign companies and Flemish property registration tax.
All the requests are sent in the form of 'reasoned opinions'. Belgium has two months to respond. It it fails to give a satisfactory response, the state may face court action.
This case also illustrates the fact that the regional authorities of the Member States are bound by the EC Treaty in the same way as the central government of Member States themselves.
